The Chicago & North Western Railway Company appeals from judgments of the circuit court for Dane county affirming three
            orders from three separate proceedings brought before the Public Service Commission assessing the appellant the entire cost
            of maintaining newly constructed, or to be constructed, highway underpass structures at highway-railroad crossings at Appleton
            avenue in Milwaukee, at U. S. Highway 141 in Sheboygan county, and in Brown county on Highway Trunk M. The appellant also
            appeals from three orders of the commission denying application for rehearing in each proceeding. Sec. 84.05, Stats., provides that where the highway commission determines that public safety or convenience of public travel
            requires a grade separation where a highway and a railroad line intersect, such commission shall make a plan of the proposed
            construction and an estimate of the cost. The commission then endeavors to negotiate with the railroad as to the proportionate
            part of the total cost which should be borne by the state and the railroad. If such an agreement cannot be reached voluntarily,
            the matter is presented to the Public Service Commission. After a hearing in accordance with secs. 195.28 and 195.29, the
            Public Service Commission is directed to fix the portion of the cost of the construction and of the maintenance which is to
            be paid by the persons or corporations concerned, and the portions of the cost, if any, to be paid by the public.
